End User License Agreement

This End User License Agreement ("Agreement") is between you and Black Eagle Group LLC ("Whispie Quest," "Company," "we," "us," or "our") regarding your use of the Whispie Quest mobile application (the "App").

By downloading, installing, or using the App, you agree to be bound by this Agreement. If you do not agree, do not use the App.

1. License Grant

Subject to your compliance with this Agreement, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App for your personal, non-commercial use on any Apple or Android device that you own or control.

2. Restrictions

You agree NOT to:

Copy, modify, or create derivative works of the App
Reverse engineer, decompile, or disassemble the App
Remove any copyright or proprietary notices
Transfer, sublicense, or distribute the App to third parties
Use the App for any illegal or unauthorized purpose
Circumvent any security features or access restrictions

3. Subscription Terms

Important Information About Subscriptions

Please read this section carefully regarding automatic renewal, cancellation, and refund policies.

3.1 Subscription Plans

3.2 Free Trial

Duration: 7-day free trial for new Premium subscribers
Cancellation: Cancel anytime during the trial without charge
Auto-Renewal: If not cancelled, the trial converts to a paid subscription

3.3 Cancellation

iOS (Apple): Settings > [Your Name] > Subscriptions > Whispie Quest > Cancel

Android (Google Play): Play Store > Menu > Subscriptions > Whispie Quest > Cancel

3.4 Refunds

iOS: Refund requests are handled by Apple. Contact Apple Support.
Android: Refund requests are handled by Google. Contact Google Play Support.

4. Activity Disclaimer

IMPORTANT DISCLAIMER

Activities provided by the App are suggestions only. They are NOT professional developmental, medical, or therapeutic advice.

Always supervise your child during activities
Assess the suitability of each activity for your child
We are not responsible for any injury resulting from activities
Consult professionals for developmental concerns

5. User Content and Data

You retain ownership of all data you input (child profiles, activity history, etc.)
By using the App, you grant us a license to use your data solely to provide the Service
We will not sell your personal data to third parties
You can request account deletion at any time

6. Privacy

Your use of the App is governed by our Privacy Policy at:

7. Intellectual Property

The App, including all content, features, functionality, design, and code, is owned by Black Eagle Group LLC and protected by international intellectual property laws.

8. Disclaimers and Limitation of Liability

The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind. To the maximum extent permitted by law, Black Eagle Group LLC shall not be liable for any indirect, incidental, special, or consequential damages. Our total liability shall not exceed the amount paid by you in the 12 months prior to the claim.

9. Apple-Specific Terms

This Agreement is between you and Whispie Quest only, not Apple
Apple is not responsible for the App or its content
Apple and its subsidiaries are third-party beneficiaries of this EULA

10. Google Play-Specific Terms

For users who download the App from Google Play, you must comply with Google Play's Terms of Service.

11. Governing Law

This Agreement is governed by the laws of the State of Wyoming, United States.
