1. Acceptance of Terms

By accessing or using Whispie Flavor Agent (the "Service") operated by Black Eagle Group LLC ("we," "our," "us"), you agree to be bound by these Terms of Service and our Privacy Policy.

2. Eligibility

You must be at least 18 years old to use Whispie Flavor Agent. The Service is designed for parents and guardians of picky eaters or children who refuse to eat without screens. By using the Service, you represent that you are at least 18 years old and are the parent or legal guardian of any child whose profile you create.

3. Account Registration and Security

You must provide accurate, complete, and current registration information. You are responsible for:

Maintaining the confidentiality of your account credentials
All activities that occur under your account
Immediately notifying us of any unauthorized use

4. Subscription Terms

4.1 Plans

4.2 Auto-Renewal

Paid subscriptions automatically renew unless cancelled at least 24 hours before the renewal date.

4.3 Cancellation

Apple App Store: Settings → [Your Name] → Subscriptions → Whispie Flavor Agent → Cancel

Google Play Store: Play Store → Menu → Subscriptions → Whispie Flavor Agent → Cancel

4.4 Refunds

iOS: Refund requests are handled by Apple. Contact Apple Support.

Android: Refund requests are handled by Google. Contact Google Play Support.

5. Medical Disclaimer

IMPORTANT: Whispie Flavor Agent is a game and family experience. It does NOT replace professional feeding therapy, occupational therapy, or medical treatment. If you suspect your child has ARFID, sensory processing disorder, or another feeding condition, please consult a qualified healthcare professional.

App content is for entertainment and exploratory purposes only
Always supervise your child during sessions
We are not liable for any incident occurring during food interaction
The app may be used as a complementary tool alongside professional support

6. Intellectual Property

All rights, title, and interest in Whispie Flavor Agent — including creature designs, game mechanics, the Sensory DNA system, content, and code — belong to Black Eagle Group LLC and are protected by international intellectual property laws.

7. Prohibited Uses

Reverse engineering or decompiling the App
Accessing via automated tools or bots
Using the App for unauthorized commercial purposes
Circumventing security features or access restrictions

8. Termination

We may suspend or terminate your account if you violate these Terms. You may terminate your account at any time through the app settings or by contacting support.

9. Regional Provisions

9.1 European Union & United Kingdom

Right of Withdrawal: For digital services provided immediately upon subscription, you acknowledge that you waive your right of withdrawal once service performance has begun.

9.2 Turkey

Consumer rights under Law No. 6502 on Consumer Protection are reserved. Consumer arbitration committees have jurisdiction for disputes.

9.3 United States — CCPA

California residents have the right to know, delete, and opt-out of the sale of personal information. We do not sell personal information.

10. Limitation of Liability

To the maximum extent permitted by law, Black Eagle Group LLC is not liable for indirect, incidental, special, consequential, or punitive damages. Our total liability shall not exceed the amount you paid us in the six months preceding the claim.
