End User License Agreement (EULA)

This End User License Agreement ("Agreement") is between you and Black Eagle Group LLC ("Company," "we," "our") regarding your use of the Whispie Flavor Agent mobile application (the "App").

By downloading, installing, or using the App, you agree to be bound by this Agreement. If you do not agree, do not use the App.

1. License Grant

Subject to your compliance with this Agreement, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App for your personal, non-commercial use on any Apple or Android device that you own or control.

2. Restrictions

You agree NOT to:

• Copy, modify, or create derivative works of the App
• Reverse engineer, decompile, or disassemble the App
• Remove any copyright or proprietary notices
• Transfer, sublicense, or distribute the App to third parties
• Use the App for any illegal or unauthorized purpose
• Circumvent any security features or access restrictions

3. Subscription Terms

3.1 Plans

3.2 Cancellation

iOS (Apple): Settings → [Your Name] → Subscriptions → Whispie Flavor Agent → Cancel Subscription

Android (Google Play): Play Store → Menu → Subscriptions → Whispie Flavor Agent → Cancel

3.3 Refunds

• iOS: Refund requests are handled by Apple. Contact Apple Support.
• Android: Refund requests are handled by Google. Contact Google Play Support.

4. Medical Disclaimer

• Always supervise your child during sessions
• Assess the suitability of each food interaction for your child
• We are not liable for any incident during food exploration

5. User Data

• You own all data you enter (child profiles, sensory responses, session history)
• By using the App you grant us a license to use your data solely to provide the Service
• We do not sell your personal data or your child's data
• You may request account deletion at any time

6. Privacy

Your use of the App is governed by our Privacy Policy:

7. Intellectual Property

The App and all content — including creature characters, game mechanics, the Sensory DNA system, design, and code — are owned by Black Eagle Group LLC and protected by international intellectual property laws.

8. Disclaimer of Warranties and Limitation of Liability

The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind. To the maximum extent permitted by law, Black Eagle Group LLC will not be liable for indirect, incidental, special, or consequential damages. Our total liability shall not exceed the amount you paid in the 12 months preceding the claim.

9. Apple-Specific Terms

• This Agreement is solely between you and the Company, not Apple
• Apple is not responsible for the App or its content
• Apple and its subsidiaries are third-party beneficiaries of this EULA
• In the event of any failure to conform to any applicable warranty, you may notify Apple for a refund of the purchase price

10. Google Play-Specific Terms

Users downloading the App from Google Play must also comply with the Google Play Terms of Service.

11. Governing Law

This Agreement is governed by the laws of the State of Wyoming, United States of America.
